Robbery Charges in New Jersey

Robbery in the first degree is a felony offense in New Jersey, punishable by 10-20 years in prison. Robbery in the second degree is a felony offense in New Jersey, punishable by 5-10 years in prison.

Most robbery charges are second degree charges. A robbery offense may become a first degree offense if the robbery involves an attempted murder, the use of a deadly weapon such as a gun or knife, or the intentional or attempted infliction of severe bodily injury. (NJSA 2C:15-1)

Burglary Charges in New Jersey

Burglary may be a second degree crime or a third degree crime in New Jersey, depending on the circumstances. A second degree crime is punishable by 5-10 years in prison, whereas a third degree crime is punishable by 3-5 years in prison.

A person is guilty of burglary if they enter a structure without valid legal authority and for the purpose of committing a criminal offense. A burglary becomes a second degree felony if the offender is armed with a deadly weapon or causes bodily injury to another person purposefully, knowingly, or recklessly. (N.J.S.A. 2C:18-2)
