- Property division: Although many New Jersey divorce cases result in equal division of assets and debts, New Jersey property division laws require fair property division (equitable distribution) in divorce. When a property settlement agreement is not achieved, the court may examine a number of factors in order to determine what is fair in the division of real estate, bank accounts, retirement accounts or investments and other marital property.
- Child custody, visitation and support: New Jersey child custody laws require that all child custody and parenting plan issues be determined in accordance with what is in the best interests of the children involved. Because it is important for children to have frequent and continuous contact with both parents following divorce, most child custody arrangements include some form of a shared parenting plan/joint custody arrangement where both parents share legal custody (the ability to make important decisions involving the child's upbringing) and one parent has primary physical custody (residential custody).
- Alimony/spousal support: Alimony is not automatically awarded in every divorce. The court considers many factors to determine if alimony is necessary, the length of time any alimony should be awarded and the amount of any alimony that is awarded. Some of the important issues considered by the court include the length of the marriage, the need for spousal support/alimony (and the other party's ability to pay), the marital standard of living and other issues.
