New Jersey Drug Possession Charges
Possession of illegal drugs or the possession of prescription drugs without a valid prescription is a criminal offense in New Jersey. A conviction for any drug possession offense can result in significant criminal and civil penalties. The severity of penalties varies depending on the type of drug, the amount of drugs that are possessed and other factors.

Specific Drug Charges
Possession of a small amount of marijuana (less than 50 grams) is a disorderly persons offense in New Jersey. A conviction for a disorderly persons offense carries a maximum fine of $1000 and a maximum jail sentence of six months.
Possession of more than 50 grams of marijuana is a crime of the fourth degree, with a maximum penalty of up to 18 months in jail. Possession of certain prescription drugs without a valid prescription may also be a crime of the fourth degree.
Possession of cocaine, meth, PCP, ecstasy, heroin and many other potentially lethal drugs is a crime of the third degree, punishable by up to five years in state prison.
